Terms and Conditions

These terms and conditions shall apply to the sale of tickets and the carriage of passengers and their luggage by ferry between a port in Montserrat and a port in Antigua on a ferry service provided by a ferry operator (hereinafter referred to as the Carrier) under a contract for services with the Government of Montserrat, (hereinafter together referred to as “We”, “our” or “us”).

1. Definitions

The following words have the following meanings:

“fare” means the amount paid for transportation by the ferry but does not include, spirits, wine, beer, soft drinks or mineral waters, or any other incidental charge or expense;

“ferry” means the vessel used for transporting passengers; luggage and goods between a port in Montserrat and a port in Antigua;

“ferry operator” The company who owns the vessel;

“one–way” means any trip that has completed one leg of travel in any direction and terminates in a port that is not the port of origin;

"passenger" includes every person who purchases a ticket and all those for whom the purchase is made, including, but not limited to dependent children, spouses and other parties;

“port” the place where passengers board the ferry or disembark from the ferry;

“ticket” applies to the document you receive upon payment of the fare and includes an electronic ticket;

“trip” the journey commencing at one port and ending at the port that is not the port of origin; and

“you” means any person, except members of the crew, carried or to be carried on the ferry pursuant to a ticket.

2. Carrier

2.1 The Carrier is not and does not hold itself out as a common carrier. Passengers (including disabled persons and persons with reduced mobility) and luggage are accepted and carried only upon and subject to these conditions which shall form part of the contract between us and the passenger.

2.2 Every person making a booking and purchasing a ticket for or on behalf of a passenger or group of passengers warrants and confirms that he has the authority of each such passenger to accept these conditions as agent for and on behalf of that passenger and that each such passenger agrees to be bound by these conditions.

2.3 We may amend these terms and conditions at any time.

3. Ticket

3.1 A ticket is valid only for the person(s) named thereon and can be transferred or modified for a fee of $25.00.

3.2 Except as otherwise expressly provided herein, these terms and conditions shall govern the contract between us and the passenger and supersede all other agreements, oral or written.

4. Currency

All prices are quoted in Eastern Caribbean Dollars (ECS).

5. Fares

The fares for travel on the Ferry between Montserrat, Antigua or Montserrat, Nevis:

6. Embarkation Tax

6.1 A departure tax, of $25 is payable at the port of embarkation by a passenger who remains in Montserrat in excess of 24 hours based on law.

6.2 A departure tax of $75 is payable by a passengers who remains in Antigua in excess of 24 hours.

Passenger shall pay Departure Tax for Stays exceeding 24 HOURS

7. Port Security Charge

A security charge of $10 is payable by passengers departing Montserrat based on the port security charge Act.

8. Travel Documents

Proper travel documentation and eligibility to travel is required. It is the passenger’s sole responsibility to ensure his/her legal eligibility to travel and to bring and have available at all times all required travel documents. Passengers are advised to check with their travel agent or the appropriate Government authority to determine the necessary documents and travel eligibility requirements. We may cancel the booking of any passenger who is or becomes ineligible to travel for any reason.

9. Ferry Schedule

The ferry schedule is subject to change without notice. We undertake to use our best efforts to carry you and your luggage with reasonable dispatch and to adhere to the ferry schedule in effect on the date of travel. However, we may change time of departure, often for reasons beyond our control, and consequently times shown in timetables cannot be guaranteed. Please refer to clauses 17&18 regarding refunds in such an event.

10. Check-In

10.1 Passengers are required to arrive at the port of departure at least one (1) hour in advance of scheduled departure time. Check in closes 30 minutes before departure time. This is to allow for immigration, customs and security requirements before departure. Failure to do so may result in a refusal to authorize embarkation.

10.2 We decline all responsibility for any delays resulting from the undertaking of the formalities set out in clause 10.1. We therefore advise you to allow additional time to check in during peak periods.

11. Baggage Allowance

11.1 A passenger is allowed to travel with 2 pieces of luggage. Each piece of luggage shall not exceed 30kgs (66lbs).

11.2 A passenger will be allowed one (1) hand luggage which shall not exceed 20lbs.

11.3 A fee of $50 is payable in respect of each piece of luggage in excess of the two pieces of luggage prescribed in clause 11.1.

11.4 A fee of $50 is payable for any unaccompanied luggage.

12. Special Assistance

12.1 A disabled person or a person with reduced mobility shall notify us of their disability or reduced mobility at the time a booking is made, and in any event not later than 24 hours before the scheduled time of departure.

12.2 We may refuse to accept a booking from a disabled person or a person with reduced mobility or refuse to embark a disabled person or person with reduced mobility:

  1. in order to comply with any applicable safety requirements established by International or local legislation or by the competent authorities; or
  2. where it is not possible to carry out the embarkation, disembarkation or carriage of such persons in a safe or operationally feasible manner due to the design of the ferry or infrastructure or equipment of a port.

13. Medical Care

The passenger admits a full understanding of the character of the ferry and assumes all risks incident to travel and transportation and handling of passengers and cargo. While at sea or in a port the availability of medical care may be limited or delayed. The passenger acknowledges that all or part of their trip may be in areas where medical care and evacuation may not be available. The passenger agrees to indemnify and reimburse us in the event that we elect to advance the cost of emergency medical care, including medical care provided ashore as well as transportation and/or lodging in connection therewith.

14. Security

Passengers, baggage, personal items and cargo may be subject to search and inspection prior to boarding the ferry. Passengers who refuse to consent to a search may be denied passage. In accordance with Maritime Law, intoxicated or disorderly persons are considered security risks and will be denied passage and/or arrested. We reserve the right to deny passage to anyone we deem a safety or security risk. No dangerous goods, cargo or firearms may be brought on the ferry without prior written or verbal consent. If in doubt as to whether items qualify as dangerous goods, please contact the Access Division before your date of departure.

15. Passenger Safety

Passengers shall at all times follow and carry out all lawful directions of the Captain, the Mate or crew members of the ferry, particularly in relation to (but not limited to) personal safety of themselves, the crew, or other passengers.

16. Animals

16.1 You must ensure that animals such as dogs, cats, household birds and other pets are properly crated and accompanied by valid health and vaccination certificates, entry permits and other documents required by a Country of entry or transit failing which they will not be accepted for carriage.

16.2 Animals, except a guide or assistance dog, must be kept in crates or in approved pet carriers and must remain in their crates or carriers for the duration of the trip.

16.3 A passenger who intends to travel with a guide or assistance dog shall advise us at the time of booking and shall provide us with current documentation (i.e., not older than one year from the date of the Passenger’s scheduled trip) on the letterhead of a licensed mental health professional (e.g., psychiatrist, psychologist, licensed clinical social worker, including a medical doctor specifically treating the passenger's disability) stating the following:

  1. that the passenger has a disability;
  2. that the passenger needs a guide or assistance dog as an accommodation for travel;

16.4 We reserve the right to authenticate any documentation submitted under clause 16.3.

16.5 A guide or assistance dog which is accepted for carriage shall wear a leash throughout the trip.

17. Cancellation By Us

17.1 There is no guarantee that the ferry will depart or arrive at the time stated on the schedule, notwithstanding, every effort will be made for on time departures as crossing times between ports may vary as a result of sea conditions and we may cancel a trip depending on sea conditions. If we cancel a trip, we shall either:

  1. carry you on another of our scheduled ferry services on which space is available without additional charge;
  2. make a refund to you in accordance with clause of 18.

17.2 In the event that we cancel a trip, the remedy outlined in 17.1 (a) and (b) are the sole and exclusive remedies available to you and we shall have no further liability to you.

18. Refund

18.1 If the ferry service is cancelled under clause 17.1 All refund requests MUST be made to the Access Division, by email to Accessmni@gov.ms or through our contact us link on the ferry booking page. We will refund a ticket or any unused portion as follows:

  1. We shall be entitled to make a refund either to the person named in the ticket or to the person who has paid for the ticket, upon presentation of satisfactory proof of such payment./li>
  2. If a ticket has been paid for by a person other than the passenger named in the ticket, and the ticket indicates that there is a restriction on refund, we shall make a refund only to the person who paid for the ticket, or to that person's order.
  3. We may be able to transfer a standard ticket to a nominee.
  4. Tickets which carry special fares such as Day tours and Weekend special, will be non-refundable and non-transferable. (refer to Clause 19.1)
  5. Refunds can only be granted up to thirty (30) days from the date of travel.

18.2 Except in the case of a lost ticket, refunds will only be made on surrender of the ticket to us.

19. Cancellation By You

19.1 If a cancellation is made by the passenger or on the passenger’s behalf two or more calendar days prior to the date of travel, a refund will be issued less the cancellation fee of $50 for standard tickets and 50% for special fare tickets.

19.2 Refunds will not be issued after the date and time of departure.

19.3 Unused reservations or those not cancelled prior to departure time will be subject to forfeiture of the entire amount.

19.4 Changes to departure dates or times made less than two days prior to the departure will be subject to a change fee of $25.

20. Liability

We are not liable whatsoever for:

  1. damage to or loss of luggage, package, or cargo of any kind;
  2. any loss or damage of any kind suffered as a result of missed onward connection on any carrier or flight anywhere at any time;
  3. perishable goods conveyed as cargo, baggage or otherwise;
  4. transportation and accommodation cost to or from any destination; or
  5. loss of business, profit, or pecuniary loss, as a result of damage to or loss of baggage cargo.

21. Jurisdiction

Any dispute between the passenger and us shall be determined in accordance with the laws of Montserrat irrespective of jurisdiction where booking was made.
